§ 1

Data Protection at a Glance

General Notes

The following notes provide a simple overview of what happens to your personal data when you visit this website. Personal data is any data by which you can be personally identified. For detailed information on the subject of data protection, please refer to our privacy policy listed below this text.

Who is responsible for data collection on this website?

Data processing on this website is carried out by the website operator. You can find the contact details in the "Note on the responsible party" section of this privacy policy.

How do we collect your data?

Your data is collected in part by you providing it to us. This may, for example, be data you enter in a contact form.

Other data is collected automatically or with your consent when you visit the website by our IT systems. This is primarily technical data (e.g. internet browser, operating system or time of the page visit). This data is collected automatically as soon as you enter this website.

What do we use your data for?

Some of the data is collected to ensure the error-free provision of the website. Other data may be used to analyse your user behaviour. If contracts can be concluded or initiated via the website, the transmitted data will also be processed for contract offers, orders or other order requests.

What rights do you have regarding your data?

You have the right at any time to receive information free of charge about the origin, recipient and purpose of your stored personal data. You also have the right to request the rectification or erasure of this data. If you have given your consent to data processing, you can revoke this consent at any time for the future. You also have the right, under certain circumstances, to request the restriction of the processing of your personal data. Furthermore, you have the right to lodge a complaint with the competent supervisory authority. You can contact us at any time regarding this and other questions on the subject of data protection.

§ 2

Hosting

We host the content of our website with the following provider:

External hosting and content delivery (CDN)

Our website is delivered by Cloudflare as our hosting and content delivery network (CDN) provider. When you visit the website, Cloudflare processes the connection data that is technically necessary to deliver the site and to protect it against attacks — in particular your IP address, browser and device information, the page requested, and the date and time of the request. As a CDN / edge provider, Cloudflare does not store the contents of contact forms; form submissions are processed by the provider named in § 4.

The use of Cloudflare is based on our legitimate interest in a secure, fast and efficient provision of our website by a professional provider, including protection against denial-of-service and bot attacks (Art. 6(1)(f) GDPR).

Cloudflare will only process your data to the extent necessary to fulfil its service obligations and follows our instructions regarding this data. Cloudflare provides a data processing agreement pursuant to Art. 28 GDPR as part of its standard terms.

Hosting provider used

Cloudflare, Inc., 101 Townsend St, San Francisco, CA 94107, USA

Cloudflare, Inc. is based in the USA. Data transfers are based primarily on Cloudflare's certification under the EU-US Data Privacy Framework (EU Commission adequacy decision of 10 July 2023); in addition, the EU Commission's standard contractual clauses (SCC) apply as a safeguard. Details can be found in Cloudflare's privacy policy: cloudflare.com/privacypolicy

§ 3

General Notes and Mandatory Information

Data Protection

The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the statutory data protection regulations and this privacy policy.

We would like to point out that data transmission over the internet (e.g. when communicating by email) may have security gaps. Complete protection of data against access by third parties is not possible.

Note on the responsible party

The responsible party for data processing on this website is:

Attestria
Bildungscampus 11
74076 Heilbronn, Deutschland
E-Mail: hello@attestria.eu

The responsible party is the natural or legal person who alone or jointly with others decides on the purposes and means of processing personal data.

Retention period

Unless a more specific retention period is stated within this privacy policy, your personal data will remain with us until the purpose for data processing no longer applies. If you make a legitimate request for deletion or revoke your consent, your data will be deleted unless we have other legally permissible reasons for storing it (e.g. tax or commercial law retention periods); in that case, deletion will take place after these reasons cease to apply.

Legal bases for data processing

Where you have given consent to data processing, we process your personal data on the basis of Art. 6(1)(a) GDPR. If your data is required for the performance of a contract or pre-contractual measures, we process it on the basis of Art. 6(1)(b) GDPR. Where processing is required to fulfil a legal obligation, it is based on Art. 6(1)(c) GDPR. Processing may also be based on our legitimate interest pursuant to Art. 6(1)(f) GDPR.

Automated decision-making

Automated decision-making, including profiling, within the meaning of Art. 22 GDPR does not take place on this website.

Recipients of personal data

We only share personal data with external parties if this is necessary for the performance of a contract, if we are legally required to do so, if we have a legitimate interest pursuant to Art. 6(1)(f) GDPR, or if another legal basis permits such disclosure. When using processors, personal data is shared only on the basis of a valid data processing agreement.

Revocation of your consent to data processing

Many data processing operations are only possible with your explicit consent. You may revoke consent you have already given at any time. The lawfulness of processing carried out before the revocation remains unaffected.

Right to object to data collection in special cases and to direct marketing (Art. 21 GDPR)

WHERE DATA PROCESSING IS BASED ON ART. 6(1)(E) OR (F) GDPR, YOU HAVE THE RIGHT AT ANY TIME TO OBJECT, ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION, TO THE PROCESSING OF YOUR PERSONAL DATA; THIS ALSO APPLIES TO PROFILING BASED ON THOSE PROVISIONS. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR PERSONAL DATA UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR PROCESSING THAT OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS, OR THE PROCESSING SERVES TO ESTABLISH, EXERCISE OR DEFEND LEGAL CLAIMS (OBJECTION PURSUANT TO ART. 21(1) GDPR).
WHERE YOUR PERSONAL DATA IS PROCESSED FOR DIRECT MARKETING PURPOSES, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF YOUR PERSONAL DATA FOR SUCH MARKETING; THIS ALSO APPLIES TO PROFILING TO THE EXTENT THAT IT IS RELATED TO SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL NO LONGER BE USED FOR DIRECT MARKETING PURPOSES (OBJECTION PURSUANT TO ART. 21(2) GDPR).

Right to lodge a complaint with the supervisory authority

In the event of violations of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, place of work or place of the alleged infringement. The supervisory authority responsible for us is the State Commissioner for Data Protection and Freedom of Information of Baden-Württemberg (LfDI Baden-Württemberg), Lautenschlagerstraße 20, 70173 Stuttgart.

Right to data portability

You have the right to have data that we process automatically on the basis of your consent or in performance of a contract handed over to you or to a third party in a commonly used, machine-readable format.

Access, rectification and erasure

Within the framework of applicable legal provisions, you have the right at any time to free information about your stored personal data, its origin and recipients and the purpose of data processing, and, if applicable, a right to rectification or erasure of this data.

Right to restriction of processing

You have the right to request the restriction of the processing of your personal data. This right applies in the following cases:

  • If you dispute the accuracy of your personal data stored with us, we generally need time to verify this. For the duration of the review, you have the right to request restriction of processing.
  • If the processing of your personal data was or is unlawful, you may request restriction of processing instead of erasure.
  • If we no longer need your personal data but you need it to exercise, defend or assert legal claims, you have the right to request restriction instead of erasure.
  • If you have lodged an objection pursuant to Art. 21(1) GDPR, a balance must be struck between your interests and ours. As long as it has not yet been determined whose interests prevail, you have the right to request restriction.

If processing of your personal data has been restricted, such data may — apart from being stored — only be processed with your consent or for the establishment, exercise or defence of legal claims or for the protection of the rights of another person or for reasons of important public interest of the European Union or a Member State.

SSL/TLS encryption

For security reasons and to protect the transmission of confidential content, this site uses SSL or TLS encryption. You can recognise an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the padlock symbol in your browser bar. If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

Objection to advertising emails

The use of contact data published in the context of the imprint obligation for sending unsolicited advertising and information material is hereby objected to. The operators of the pages expressly reserve the right to take legal action in the event of the unsolicited sending of advertising information, such as spam emails.

§ 4

Data Collection on This Website

Server log files

Our hosting provider automatically collects and stores information in so-called server log files, which your browser transmits automatically. These are: browser type and version, operating system used, referrer URL, host name of the accessing computer, time of the server request, and the IP address.

This data is not merged with other data sources. It is collected on the basis of Art. 6(1)(f) GDPR; the operator has a legitimate interest in the technically error-free presentation, optimisation and security of its website, which requires server log files to be recorded. The data is stored only for a short period and then deleted.

Cookies and local browser storage

This website does not use any tracking, analytics or marketing cookies. Our content delivery provider Cloudflare may set a technically necessary cookie (e.g. __cf_bm) to distinguish human visitors from bots and to protect the site against abuse; this cookie serves security purposes only, is not used to track you, and is exempt from consent under § 25(2) TTDSG. Your language preference (German/English) is stored exclusively in your browser's local storage (localStorage); this data remains on your device, is not transmitted to our servers, and can be deleted at any time via your browser settings.

Contact form

If you send us enquiries via the contact form, the information you provide, including the contact details given, will be stored for the purpose of processing the enquiry and in the event of follow-up questions. We will not share this data without your consent.

We collect the following data:

  • First and last name (required)
  • Email address (required)
  • Phone number (optional)
  • Company name (optional)
  • Your message / request (optional)

Providing the fields marked as required is necessary for us to process your enquiry; without them we cannot respond. All other details are optional.

Processing is carried out on the basis of Art. 6(1)(b) GDPR where your enquiry is related to the performance of a contract or necessary for pre-contractual measures. In all other cases, processing is based on our legitimate interest in the effective handling of enquiries (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR); consent can be revoked at any time.

The data you enter in the contact form will remain with us until you request deletion, revoke your consent or the purpose for data storage no longer applies. Mandatory statutory provisions — in particular retention periods — remain unaffected.

Marketing communication

On the contact form you can optionally consent to receiving communication from us (e.g. product news and information about Attestria). For this we process your name and email address solely on the basis of your consent (Art. 6(1)(a) GDPR). You can withdraw your consent at any time with effect for the future, e.g. by email to hello@attestria.eu, without affecting the lawfulness of processing carried out before the withdrawal. Giving this consent is voluntary; declining has no effect on your demo request.

Formspree (form processing)

Form data is transmitted via the Formspree service of Formspree, Inc., 2093 Philadelphia Pike #1764, Claymont, DE 19703, USA. Formspree acts as a processor pursuant to Art. 28 GDPR and processes your data exclusively according to our instructions.

The transfer of data to the USA is based on the standard contractual clauses (SCC) of the EU Commission. Further information can be found in Formspree's privacy policy: formspree.io/legal/privacy-policy

Enquiries by email

If you contact us by email, your enquiry including all resulting personal data (name, enquiry) will be stored and processed for the purpose of handling your request. We will not share this data without your consent.

Processing is based on Art. 6(1)(b) GDPR where your enquiry is related to the performance of a contract, otherwise on Art. 6(1)(f) GDPR (legitimate interest in handling enquiries). The data will remain with us until you request deletion or the purpose no longer applies.
